Scope and contracting parties
These terms govern use of Bastyra by professional coaches, organisations and athletes. The organisation purchasing a Bastyra plan acts for professional purposes. A coach contracts directly with each athlete for coaching services; Bastyra provides software and, where enabled, payment and marketplace infrastructure.
Account eligibility
Users must provide accurate information, protect their login and be legally capable of entering the applicable contract. Coach accounts are restricted to qualified professionals or authorised organisation staff. Athletes must comply with the Athlete Code of Conduct; minors may only use the service through an approved guardian process.
Availability
Bastyra may change the service and may suspend access for security, unlawful use or material breach. Planned maintenance and incidents may affect availability. No uninterrupted or error-free service is promised, and organisations should keep reasonable operational contingency copies.
Sport and medical safety
Bastyra is a programming and record-keeping tool. It does not provide medical care, diagnosis, emergency support or replace professional judgement. Each coach is solely responsible for the content, suitability, progression, screening, supervision and lawful delivery of the training service they provide. Athletes remain responsible for giving accurate information, following safety instructions and stopping when pain or concerning symptoms occur.
Artificial intelligence
IA Coach provides optional automated suggestions, not professional or medical decisions. The coach must verify every output and remains responsible for any training or nutrition decision. Do not enter directly identifying or unnecessary sensitive information in free-text questions.
Acceptable use
Users must not upload unlawful content, impersonate others, access another organisation, share credentials, reverse engineer security controls or use the service to harm, discriminate against or unlawfully monitor a person. Before the first marketplace payment, coaches and athletes must use Bastyra messaging and must not exchange contact details, external links or social-media handles to bypass the marketplace. Safety reports must be made in good faith, limited to relevant facts and must not be used for retaliation, harassment or knowingly false accusations.
Trust and safety decisions
Bastyra may investigate reports, request supporting information, hear the person concerned, issue warnings, restrict marketplace visibility, suspend access or close access after a documented review. Except where immediate action is necessary to prevent serious harm or comply with law, the person concerned is given an opportunity to respond. Affected users may request review through the privacy contact. Reports that are unsubstantiated or dismissed do not create a notice for other coaches.
Data and confidentiality
The organisation must give athletes the required privacy information, collect only necessary data, keep accounts accurate and answer athlete requests. Bastyra processes athlete data under the Data Processing Agreement.
Payments between coaches and athletes
When a coach enables athlete payments, the coach is the merchant and contracts directly with the athlete. The coach sets prices and remains responsible for taxes, invoices, service delivery, cancellations, refunds, disputes and lawful pre-contract information. Stripe processes the payment for the coach. For athletes introduced through Bastyra Match, Bastyra may charge the application fee disclosed before the proposal is sent; the fee does not apply to athletes acquired independently.
Marketplace introductions
Only coaches with a paid active Bastyra subscription and verified credentials may be listed or access marketplace requests. A relationship introduced through Bastyra Match must complete its first contract and payment through Bastyra. Attempts to obtain contact details or move the introduced athlete off-platform before that payment may lead to marketplace restriction or account suspension after review. Once payment is confirmed, contact exchange is enabled. This rule does not claim a fee on an independently acquired athlete.
Intellectual property
Bastyra software, design and shared exercise library remain protected. Users retain their original content and grant Bastyra only the permission needed to host and operate it.
Responsibility and indemnity
Each user is responsible for their own content, instructions, conduct and breach of law. To the extent permitted by law, a professional user must reimburse Bastyra for documented third-party losses caused by that user’s unlawful conduct, professional negligence, infringement or material breach, after being given notice and a reasonable opportunity to participate in the defence. This does not apply to loss caused by Bastyra.
Liability
Nothing excludes or limits liability where the law does not permit it, including liability for fraud, intentional misconduct, gross negligence, unlawful personal-data processing, or harm to life, physical or moral integrity or health where exclusion is prohibited. Subject to mandatory law, Bastyra is not the provider of third-party coaching and is not responsible for a coach’s prescription, supervision, professional acts or an athlete’s misuse. Any valid contractual cap or exclusion applies only to direct, foreseeable losses and never removes mandatory statutory rights.
Commercial launch
Live charges remain disabled until the operator’s legal and tax setup is complete and the Commercial Terms are put into effect. Before any charge, the checkout must show the plan, total price and applicable tax treatment, renewal period, trial, cancellation method and the fact that the action creates a payment obligation.
Complaints and disputes
Users should first contact bastyra.privacidade@gmail.com. Where consumer law applies, mandatory complaint, alternative-dispute-resolution and court rights remain available. No clause prevents a person from bringing a lawful complaint or claim.
